BEACHWALK HOMEOWNERS ASSOCIATION
ARCHITECTURAL COMMITTEE CHARTER

By the direction of the Board of Directors of the Beachwalk Homeowners Association the Charter is established to govern activities of the Architectural Committee. The authority for this Charter, is set forth herein, is to be found in the Bylaws, Article VIII, established for Beachwalk Homeowners Association and duly recorded in the official records in Orange County, California.


ARTICLE I


PURPOSE
: In order to maintain the architectural character and integrity of this community, the Architectural Committee has been established to assure that all permanent external modifications or structural additions shall be in accordance with the Architectural Standards and Approval Procedures of the Beachwalk Homeowners Association. These requirements are designed to maintain, protect and enhance your neighborhood.


ARTICLE II


MEMBERSHIP:
The Architectural committee shall consist of a Chairperson being duly elected member of the Board of Directors and an appointed committee of at least four members.


ARTICLE III


MEETINGS:
The Committee shall meet monthly to perform its duties. A quorum to conduct a meeting should be at least 4 members. The vote of a majority of the members present at the committee meeting, or the vote of a majority of the members of the committee taken without a meeting, shall constitute an act of the committee.


ARTICLE IV


CONFORMANCE ASSURANCE:
The Committee or its duly authorized representatives may, at any time, inspect any permanent external modifications or structural additions for which approval is required to determine if approval was obtained and to determine compliance with the conditions of the approval. In the event of noncompliance with either the approval process or the conditions of the approval, the homeowner responsible will be notified within five (5) days from the inspection, specifying the particulars of noncompliance and requiring the homeowner to take such action as may be necessary to remedy the noncompliance. The right of the Association to remedy a noncompliance shall be in addition to all other rights and remedies which the Association may have at law, in equity or in this Charter.


ARTICLE V


NON-LIABILITY OF COMMITTEE MEMBERS:
Neither the Committee nor any member of the Committee, the Board, nor their duly authorized representatives shall be liable to the Association, or to any owner for any loss, damage or injury arising out of or in any way connected with the performance of the Committee's duties hereunder, unless due to the willful misconduct or bad faith of the Committee.


ARTICLE VI


ARCHITECTURAL STANDARDS:
The Committee shall adopt rules on architectural style to maintain the character and integrity of the community including, but not limited to characteristics of size, shape, color and materials. The standards shall consider, but not be limited to buildings, walkways, stairs, steps, external doors, windows, walls, fences, retaining walls, patio covers, external exposed plumbing fixtures, external lighting fixtures, antennae and drainage.


ARTICLE VII


APPROVAL PROCEDURE:
The Committee shall adopt procedures for the submission and disposition of requests for approval of projects. The approval procedure will provide conditions of approval. The disapproval procedure will disclose the reason(s) for disapproval, request additional information if needed, and advise the homeowner how to appeal the disapproval decision.


ARTICLE VIII


PRECEDENCE:
There is no intent by this Charter, Architectural Standards or Approval Procedure to supersede the Beachwalk Homeowners Association Declaration of Covenants, Conditions Restrictions and Reservation of Easements, by-laws of the Homeowners Association.


ARTICLE IX


CHANGES:
Any modification, addition or deletion to this Charter, Architectural Standards, or Approval Procedure will be submitted to the Board of Directors at the regularly scheduled Board meeting and will become effective thirty (30) days thereafter, with concurrence of the majority of the Board.


ARTICLE X


BUILDING PERMITS: Approval of plans submitted to the Committee does not relieve the homeowner from complying with all ordinances and regulations, and obtaining the necessary building permits from the City of Huntington Beach Building Department prior to the commencement of construction.
