Introduction
This criteria is provided by the Architectural Committee to assure a uniform external appearance and architectural compatibility within Beachwalk. "Solar tube" is a generic name for a sun/day light transmitting tube with a mirrored inside diameter intended to provide natural light where needed inside a residence. The word "device" will be used in this criteria to describe both solar rubes and sky lights. Exception will be noted.
External Appearance
The device shall not protrude above the existing pitched roof ridge line. That is to say, the maximum height of the installed external dome shall be less than the maximum height of the pitched roof where the device tube is installed. In addition, the installation for flat or pitched roofs, the external dome shall not protrude above the roof surface more than 10" above the original roof surface for a solar tube and 15" for a sky light.
Building Codes
It is required that the Huntington Beach Building Department codes be complied with. In discussion with the Eddie Lee (714) 374-1538 of the Building Department on January 4, 2010 he stated “No permit is required if solar tube or skylight is installed between the existing rafter joists. If the existing rafter joists are cut for a larger opening a permit will be required, device must be identified with an ICC ESR # and comply with Title 24 energy code.” The building code also requires that the edge of the cutout be no less than 36" from your property line. The property line used for this requirement is defined as the closest surface of the common wall between the owner's residence and his neighbor on either side or the side of the building for an end unit. Frank Bignone (Chief Mechanical inspector) stated if any devices is open to outside air it must be a minimum of 10’ from any plumbing vent pipes. If your device installation includes an internal electric light, a building permit is required. It is the homeowner's responsibility to comply with current building codes for the intended project. The codes are subject to revision without notification. Copies of building permit applications, permits granted and city inspection buyouts must be provided to the Architecture Committee within one month after the final City buyout. Regardless of code requirements, the Architectural Committee reserves the right to inspect work in progress or the completed project to insure compliance with the specific project description approved by the Committee. It is the homeowner's responsibility to inform the Architecture Committee when work begins and is completed.
Roof Leakage Liability
The homeowner is responsible for repairing any water leaks resulting from the installation of any device. This liability includes water leak damage to the roof structure and water damage to the residence interior and its contents. A signed statement of homeowner's leakage liability (available from Keystone Pacific Property Management Inc., (949) 833-2600) must be provided to the Architecture Committee with the initial project application. Roof leakage responsibility reverts from the homeowner to the roofing contractor after the first re-roofing provided by the Homeowners Association following the device installation.
Suggestions
More sun light will be available if your device is installed on a south facing roof or at least not in the shade of adjacent roofs or trees. The solar tubes generally have either flexible joints or are made of a flexible material so the tube need not be mounted on the roof directly above the desired light diffuser location on the room ceiling. The solid tubes with two flexible joints are generally more efficient light transmitters than the flexible tubes resembling a clothes dryer vent hose.
Owner must submit a roof plan showing the location of all vent plumbing pipes. No operable skylights or vented to outside air solar tubes are permitted within 10’ of said vents.
Skylights and solar tubes over 14” will require a permit if rafters are cut. They will also have to have an ICC # and be UL rated (if operable) and comply with energy code T-24. Electrical permit required if new outlet is required.
